1. The service
Total Artist is a software-as-a-service product that uses artificial intelligence to help you generate landing pages and websites from a brief. You can create an account, describe what you are building, generate and refine designs in the studio, export HTML where your plan allows, and publish public pages at URLs under https://1-artist.com/p/[slug].
New accounts typically receive one free page generation. Further generation, refinement, export, and publishing require a paid plan or purchase, as described on our Plans page. Plan details, limits, and pricing may change; the catalogue shown at checkout at the time of purchase controls what you buy.
2. Acceptance
By creating an account, signing in, or using Total Artist, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use Total Artist on behalf of an organization, you represent that you have authority to bind that organization.
3. Accounts
You must provide accurate registration information and keep your login credentials secure. You are responsible for activity under your account. Notify us promptly at support@totalartist.com if you suspect unauthorized access.
Authentication is provided via email and password, and optionally Google sign-in where enabled. You must be old enough to form a binding contract in your jurisdiction (and at least 16 where that is the local digital-consent age for similar services).
4. Acceptable use
You agree not to use Total Artist to:
- Create, host, or promote illegal, fraudulent, or harmful content
- Infringe others' intellectual property, privacy, or publicity rights, or misrepresent affiliation with a brand or person
- Abuse the AI or infrastructure (scraping, automated bulk generation beyond plan limits, reverse engineering, or attempts to bypass rate limits or billing)
- Distribute malware, phishing pages, spam, or content that exploits minors or facilitates violence or hate
- Interfere with other users or the integrity or security of the service
We may suspend or terminate accounts that violate these rules, or content that we reasonably believe creates legal or operational risk.
5. AI-generated content
Outputs are produced with AI models and may be incomplete, inaccurate, biased, or unsuitable for your use case. You are solely responsible for reviewing, editing, and deciding whether to publish or commercially use any generated design, copy, or code.
We do not warrant that outputs are error-free, unique, non-infringing, or fit for a particular purpose. You should not rely on the service as a substitute for legal, design, accessibility, or compliance review.
6. Intellectual property
Your content. You retain ownership of the briefs, prompts, brand assets, and other materials you submit, and of the resulting designs you create with the service, subject to these Terms and any third-party rights in underlying models, fonts, or stock assets. You grant Total Artist a limited license to host, process, display, and transmit your content as needed to operate and improve the product (for example, rendering previews and published pages).
Our platform.Total Artist and its software, UI, branding, documentation, and underlying systems remain our property (or our licensors'). These Terms do not transfer any ownership of the platform to you.
Feedback. If you send suggestions or feedback, we may use them without obligation to you.
7. Billing and Paddle
Paid plans and one-time purchases are processed by Paddle as Merchant of Record. That means Paddle handles checkout, taxes where applicable, invoices, and payment method data. We receive billing entitlements and related identifiers so we can unlock the features you purchased.
Available offerings may include a one-time Single page purchase and subscription plans such as Studio, Atelier, and House. Subscriptions renew until cancelled according to the interval shown at checkout. You authorize recurring charges for active subscriptions.
Refunds are described in our Refund Policy. Failure to pay may result in loss of paid features while free or previously purchased entitlements remain subject to these Terms.
8. Published pages
If you publish a page, it may be publicly reachable at a Total Artist URL. You are responsible for the content you publish and for unpublishing or deleting it when appropriate. We may remove published pages that violate these Terms or applicable law.
9. Availability and changes
We aim for reliable uptime but do not guarantee uninterrupted or error-free service. Features may change, and we may modify or discontinue parts of the product with reasonable notice where practicable. Continued use after material updates to these Terms constitutes acceptance of the updated Terms when we post them on this page with a new "Last updated" date.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS AND THIRD-PARTY SERVICES (INCLUDING PAYMENT AND HOSTING PROVIDERS) ARE OUTSIDE OUR FULL CONTROL.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL ARTIST AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US (VIA PADDLE) FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS IF YOU HAVE NOT PAID.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
12. Indemnity
You agree to indemnify and hold harmless Total Artist and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your content, your published pages, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts in England and Wales have exclusive jurisdiction, except that if consumer protection law in your country of residence requires otherwise, those mandatory rights remain available to you.
